PROCEDURE FOR THE COMPREHENSIVE EVALUATION OF THE SOCIO-ECONOMIC SITUATION OF NATURAL PEOPLE APPLYING FOR SUBSIDIES FOR CONSTRUCTIVE ACTIONS IN THEIR HOUSING.

Agreement No. 8093 dated February 23, 2017 of the Council of Ministers, "Regulations for the granting of subsidies to natural persons interested in carrying out constructive actions in their homes", in its Third Final Provision sent to the Minister of Labor and Social Security to update the procedure for the analysis of the economic solvency of the applicants of subsidy that includes the social characterization of the family nucleus, the insufficient income for the payment of the construction, repair or conservation work of the house and to fix the maximum limits for case evaluation,

The evaluation of the socioeconomic situation of the family nucleus or of the living people, is carried out by the municipal Labor directorates, and includes the social characterization and the insufficiency of the income for the payment of the construction, repair or conservation work of the house. .

The Municipal Labor Director, at the request of the Municipal Housing Directorate, designates an official so that, within a term of fifteen (15) business days, he / she can carry out the socioeconomic investigation and present the corresponding opinion, according to the format attached and is an integral part of this.

 

The social characterization of the family nucleus or of those living together, contains:

  1. Names and surnames, age and employment situation of those living in the family nucleus.
  1. Economic income of each of the cohabitants, broken down into the concepts for which they are received: (salary, income from self-employment, other income (worker of the Agricultural Production Cooperative, Credit and Services Cooperative, Basic Unit) of Cooperative Production or other cooperatives), Social Security pensions or monetary benefits from Social Assistance):

2.1 The economic income declared by the applicant is verified as follows:

      • In the case of state sector workers, income is certified by the entity where they work.
      • Social Security beneficiaries through their checkbook or monthly accreditation to the bank account associated with the magnetic card for which they charge.
      • Self-employed workers present the last affidavit made by the applicant; failing that, the certification issued by the National Tax Administration Office that guarantees their income or the Summary Model of income and expenses of the self-employed worker, which reflects the declared income.
      • Land holders, members of Cooperatives of Agricultural Production, Credit and Service, basic units of Cooperative Production and non-agricultural cooperatives, present a certification of the cooperative or the Basic Production Unit to which they belong; failing that, they present certification issued by the National Tax Administration Office that guarantees their income.
      • Expenses for obligations and debts contracted (debts for bank credits, judicial liens, alimony, and other monthly taxes) through the corresponding supporting documents in each case.

      2.2 When any member of the family nucleus receives income for more than one of the  previously mentioned concepts, demonstrate each type of income.

      1. Description of the situation that the house presents, according to the observation of the social worker.
      1. Basic expenses for food, medicine and the payment of water, electricity and telephone.
      1. Description of the health and / or disability situation of the cohabitants of the family nucleus or any other social problem presented by the family.
      1. Information on the social and economic situation, obtained in the community where the applicant resides.

As a principle, to be able to receive a subsidy, people in the family nucleus of working age, separated from work with the capacity to do so, cannot coexist.

The official designated by the Municipal Labor Director, with the elements contributed by the social characterization, evaluates the economic solvency of the family nucleus as follows:

  • All the income received by the family nucleus is added;
  • expenses are deducted from this income for obligations and debts contracted (debts for bank credits, judicial liens, alimony and other monthly taxes);
  • The result of this operation is divided by the number of family members, to determine the available per capita income.

In the evaluation of the economic solvency to receive the subsidy, maximum limits are set, taking into account the available per capita income and other situations of vulnerability of the Family nucleus. If the per capita is less than or equal to 300 (three hundred) pesos, the family nucleus may benefit from a subsidy.

Exceptionally, families with per capita above 300 (three hundred) pesos and less than or equal to 600 (six hundred) pesos can benefit from subsidy, whenever the situations occur following:

  • Women or men heads of household, alone, in the care of minors, chronically irreversible patients, people with disabilities or older adults;
  • mothers and fathers in the care of two or more children under 12 years old;
  • older adults living alone or with other older adults, without family support;
  • nuclei where all their cohabitants have disabilities; and
  • nuclei that present critical situations, fundamentally to eradicate vulnerable housing conditions.

In the evaluation of the economic solvency to receive the subsidy, maximum limits are set, taking into account the available per capita income and other situations of vulnerability of the Family nucleus. If the per capita is less than or equal to 300 (three hundred) pesos, the family nucleus may benefit from a subsidy.

Exceptionally, families with per capita above 300 (three hundred) pesos and less than or equal to 600 (six hundred) pesos can benefit from subsidy, whenever the situations occur following:

  • Women or men heads of household, alone, in the care of minors, chronically irreversible patients, people with disabilities or older adults;
  • mothers and fathers in the care of two or more children under 12 years old;
  • older adults living alone or with other older adults, without family support;
  • nuclei where all their cohabitants have disabilities; and
  • nuclei that present critical situations, fundamentally to eradicate vulnerable housing conditions.

After receiving the opinion prepared by the designated official, within three (3) business days, the Municipal Labor Director presents the results of the socioeconomic investigation to the Directorate Municipal Housing, for the appropriate purposes.

In case the subsidy approved due to the death of the beneficiary or definitive departure from the country is canceled and the person with the right to housing submits a request to the Municipal Housing Authority to continue it , it corresponds to the Municipal Labor Directorate to carry out a socioeconomic investigation, adjusted to the new conditions, for its subsequent presentation to the Administration Council, within a term of fifteen (15) business days.
