Complying with the implementation of the current legislation approved to grant the delivery of resources to families in critical social situations and exceptionally for presenting a serious situation of health, disability or lack of economic income due to the impossibility of working. < / p>

  1. The delivery of resources must be adjusted to the real possibilities of the economy. Its granting is of an exceptional nature, based on serious situations of health, disability or lack of income due to the impossibility of working.
  1. The resources are marketed in the MINCIN retail network, at prices without subsidies, from having the financing in the plan for their acquisition, and may also use merchandise from abandonment, seizures and discards of tourism.

 The payment method will be, using the following modalities:

  • By checks, between agencies charged to the Social Assistance budget.
  • It is paid in cash by the beneficiary.
  • When the insufficient income of the family nucleus to buy the resources is demonstrated, a monetary cash benefit is granted, equivalent to the partial or total value of its sale price.
  1. For the resources that are not offered in the sales network released in CUP, the network of establishments linked to the Special Programs will be used, with one store per Municipality. This network will commercialize in a controlled way the resources framed in the Plan for this destination.
  1. The evaluation of these deliveries will be carried out in a collegial manner, through working groups, coordinated by the Director of Labor and made up of representatives of the Ministries of Public Health, Education and Internal Trade. The proposal for approval is presented to the corresponding People's Power Administration Council.
  1. Two levels of decision are established for the granting of resources:
  • Municipal (rubber, antiseptic fabric, clothing, footwear, sheets, towels, covers, furniture, mattresses and kitchen utensils).
  • Provincial (household appliances effects, after substantiation by MINSAP, of the health situations for which it is essential), at the request of the corresponding Municipal Administration Council.
  1. Annually, based on needs, financing for the production or acquisition of resources is included in the economy plan (MINCIN).

Requisitos.

Awarded to working mothers of children with severe, irreversible and permanent disabilities, in vegetative and bedridden states, with a tendency to progression over time and profound effects on the neurocognitive and adaptive functions of the environment in pediatric age, without the possibility of institutional care.

For the provision of the service, the following requirements must be met:

  • The mother was linked to the job at the time of the child's birth or when the child became disabled;
  • has abandoned his employment relationship due to the need to dedicate himself to his care;
  • the child's degree of disability prevents him from accessing the national education system, including any type of educational care or other institutional alternative of MINSAP;
  • The child with severe disabilities is in pediatric age, considering that at this stage they benefit from outpatient rehabilitation and stimulation programs, as well as educational and psycho-pedagogical programs, essential for the evolution, prognosis and maintenance of the quality of life.

Characteristics.

Mothers protected with this modality receive a temporary monetary benefit from Social Assistance equivalent to their last earned salary, except the stimulation in freely convertible currency.

In the case of the worker who earns a salary linked to the systems of payment by results, the average salary resulting from the wages accrued by her is credited, during the six months immediately prior to the date of her termination of employment.

Mothers have the right to receive the scale salary increase that is made, as part of the salary policy that is applied, excluding the new additional payments that are approved.

When salary increases are approved, the municipal Deputy Director for Prevention, Assistance and Social Work will request certification from the Director of Human Resources at his last workplace, reflecting the increase in the salary approved for the position he held.

The mothers of children with severe disabilities who receive the 85 pesos, corresponding to the increases made to Social Assistance benefits, in 2005 and 2008, will continue to enjoy this income, which decreases, in the same amount as wage increases are made. New approved applications will only receive the benefit equivalent to the last salary earned.

For the enjoyment of other Social Assistance benefits in those family centers where the mother receives salary protection, the requirements established for its granting must be met. Similar analysis is taken into account for modification or extinction of the benefits they currently receive.

Corresponds to the Director of Municipal Work:

  • Manage the worker's employment file, with the administration of the workplace to which she belonged;
  • Enable the Registry of Wages and Service Time, model (SNC-2-25) and keep it updated, complying with the provisions of the legislation for these purposes;
  • Promote the retirement process when appropriate, through the municipal INASS Affiliates.

For new applications that are submitted and meet the established requirements, the recognition is approved, from the date of approval in the Board of Directors of the Ministry of Labor and Social Security, of the period dedicated to the care of your child, such as service time for retirement purposes. If further checked, that the family nucleus presents economic insufficiency, an exceptional temporary monetary benefit is approved.

The granting of modification or termination of this type of protection is the power of the Department of Prevention, Assistance and Social Work of the Ministry of Labor and Social Security.

The Ministry of Labor and Social Security acts as the Relationship Body for Associations of People with Disabilities: National Association of the Blind (ANCI); Cuban Association of Limited Physical Motors (ACLIFIM) and National Association of the Deaf of Cuba (ANSOC), contributing to the fulfillment of its objectives and the coordination and development of its activities, by virtue of Law No. 54 called "Associations Law" of December 27, 1985.

For the development of this function, the Rules of Relations between the Ministry of Labor and Social Security and the Associations are issued, in accordance with the provisions of Chapter V of the Regulations of the Law No. 54 of 1985, "Law of Associations", constituting a mandatory working document. The referred & nbsp; rules are applicable at all levels, being registered with the Association Registration Directorate of the Ministry of Justice.

The National Council for the Care of Persons with Disabilities (CONAPED), a multisectoral working group, operates to monitor and evaluate the progress of programs for the care of people with disabilities.

CONAPED is a collegiate body chaired by the Minister of Labor and Social Security and made up of state agencies and institutions, whose functions include caring for this population group, with the participation of the Associations and as guests, the political and mass organizations.

In the provinces and municipalities, the Provincial and Municipal Councils operate with the same structure, which are in charge of territorial application of the programs that include as priority objectives:

  • accessibility in different environments;
  • prevention, intervention and rehabilitation of the disabled person;
  • promote the inclusion of actions in community development plans that facilitate adjusting the resources and decisions of the community to the solution of their local problems.

For the execution of the programs, close coordination is maintained with the Associations of People with Disabilities.

Each organ, body and institution that makes up the Council designates a permanent representative, who is responsible for compliance with the agreements that are adopted.

For the operation of these groups, meetings are held on a quarterly basis, and once a year, a balance meeting is convened to analyze the results of compliance with the programs and tasks that contribute to raising the standard of living of these people.

For the granting of the Social Assistance at Home service on an exceptional basis, a casuistic analysis is carried out and its approval is individual. It is proposed to the Minister of Labor and Social Security by one of the following authorities:

  • The head of the national organ, body or other entity;
  • The head of the national leadership of a political, mass and social organization;
  • The President of the Provincial Administration Council and the President of the Isla de la Juventud Special Municipality;
  • The National Director of Prevention, Assistance and Social Work.

It is considered an exceptional situation for which the service request is made, when the following circumstances occur:

  • The responsibility of the worker is relevant for the economic, scientific or social development of the country;
  • He is the only cohabitant of the person with a disability and does not have siblings or other obligated relatives.

The proposal is made in writing and is accompanied by the following elements:

  • Name, surname, age and sex of the worker, as well as the time of services provided;
  • Name of the center, company and body to which it belongs;
  • Name of the position, occupational category and salary;
  • Certificates accrediting time of services rendered and wages earned;

The Minister of Labor and Social Security submits the proposal to the analysis of his Board of Directors. About what was agreed, informs the Provincial Director of Labor in writing, who notifies the applicant.

The National Director of Prevention, Assistance and Social Work is responsible for controlling requests for the exceptional service of Social Worker at Home and for alerting the Minister of Labor and Social Security of any irregularity that is detected.

Review of the approved benefit.

The Municipal Labor Director plans and controls the verification at least every three months, with the aim of verifying if the conditions that gave rise to the protection are maintained or modified.

If it is found that the Social Worker does not comply with the functions established in his employment contract, he will proceed in accordance with the provisions of current labor legislation.
