PROCEDURES FOR THE GRANTING, IMPLEMENTATION, CONTROL AND REVIEW OF MONETARY AND SPECIFIC BENEFITS OF SOCIAL ASSISTANCE

Objectives:

  • Control the actions of the Prevention, Assistance and Social Work specialist, the Deputy Director or Head of Department of the area, the Director of Municipal Work and all those officials who participate in the granting, execution, control and review of the benefits of the social assistance.
  • Strengthen internal control and prevent the occurrence of acts of corruption, theft and other negative behavior.
  • Promote the education and training of the personnel linked to this activity.

Documentation of the family nucleus file.

The file of the family nucleus that is the object of social assistance contains the following documents:

  • Initial interview;
  • Socio-economic research report;
  • Evidence documents;
  • Decisions taken;
  • Notification to the beneficiary of the approved decision;
  • Summary of the benefits granted;
  • Report of the revision carried out, as appropriate.

The required documentation must appear in each file, in the following order:

Document No. 1: Initial interview

  • Request and reasons.

Document No. 2 : Socio-economic research. (to understand):

  • Names and surnames of the owner or representative of the family nucleus, home address and date of the visit made;
  • Names, surnames and age of the cohabitants;
  • Economic income of each one of the members of the family nucleus by: wages, alimony, family aid, Social Security pensions, benefits and Social Assistance services;
  • Description of the health and disability situation of the affected person;
  • Description of the required family members of each member of the family nucleus (Name, relationship, address, income, if working (position and workplace), willingness to provide assistance to the applicant family nucleus;
  • Description and physical condition of the dwelling, as well as the fundamental expenses of the home, broken down into its fundamental concepts (Payment of electricity, medicines, Social Credits, etc.).
  • Community views;
  • Proposal for the protection of the family nucleus requested by the investigating specialist.

Document No. 3: Evidence documents. (As appropriate).

  • Any other document that supports the request made.
  • Document issued by the penitentiary establishment, proving that the relative of the applicant for social assistance benefits is in prison, stating if he works and the amount of income he receives;
  • Document issued by the management of the center where the young orphan aged 17 or over in need of protection is studying;
  • Certification of wages or subsidies, issued by the entity where the member of the applicant's family nucleus works;
  • Opinion of the Labor Medical Expert Commission, on the incapacity for work of people of working age, except in cases of notorious incapacity;
  • Comprehensive evaluation issued by the defectologist of the health area if it is a person with severe disability;
  • Summary of medical history;
  • Diagnostic certificates in case of noticeable disability;
  • Identity card to prove the age, address where the applicant resides and identity, by exhibition.

In the case of protection for mothers of children with severe disabilities, the following documents must also be collected:

  • Medical certificate with the diagnosis and treatment indicated for the minor;
  • Psychopedagogical characterization, performed by the MINSAP defectologist;
  • Report of the Center for Diagnosis and Orientation (CDO), summarizing the diagnosis, possibilities of insertion into educational system or other psychopedagogical or labor insertion alternatives;
  • Letter from the mother's workplace reflecting the reasons for the loss of the employment relationship, the occupation or position held by and the last salary accrued, signed by the head of human resources of the entity;
  • Mother's employment record.
  • In the case of mothers who have not lost the employment relationship, but are on unpaid leave due to the impossibility of keeping working, instead of filing the employment record, the presentation of the Certification of Years of Service and Earned Wages throughout your career.

Document No. 4: Certification of the agreement adopted by the Board of Directors of the Municipal, Provincial Labor Directorate or the Board of Directors of the Ministry of Labor and Social Security, as appropriate.

This certification contains the following aspects:

  • Name and surname of the owner;
  • Date of analysis in the Board of Directors and agreed decision;
  • Name and surname, signature of the Director of Municipal, Provincial Work or of the National Director of Prevention, Assistance and Social Work with the date on which the certification is issued.

In the case of proposals for exceptional temporary monetary benefits, the file will be accompanied by a summary containing:

Document No. 5: Grounding of the proposal presented by the Provincial Director of Labor to the Board of Directors of the Ministry of Labor and Social Security, with the following items:

  • Name and surname of the owner and file number;
  • Synthesis of the situation described in the socioeconomic research that endorses the protection proposal (physical and health conditions of the members of the nucleus, economic income and routes by which it is received, fundamental expenses and housing conditions)
  • Description of the situation of the relatives forced to provide help;
  • Amount of the proposed temporary exceptional monetary benefit;
  • Name and surname, signature of the Provincial Director of Labor and date the proposal is issued.

In order to guarantee quality in the processing of benefits in different instances, in the preparation of the family nucleus file, the municipal Social Assistance specialist must ensure the compliance with the following aspects:

  • Documents in good condition, minted and signed by the authority empowered to issue them.
  • Legible handwriting and foliated pages with consecutive numbers.
  • In the documents prepared during the investigation, decision, notification or to submit the proposal to the highest instance, the date, name and surname of the specialist or official who carried out must be recorded the process of each stage or that adopted the decision.
